Referral program rules

PLEASE, CAREFULLY READ THIS DOCUMENT AND WHITEMARKET TERMS OF USE PRIOR TO PARTICIPATION IN OUR REFERRAL PROGRAM. IF YOU DO NOT ACCEPT THE TERMS OUTLINED HEREINAFTER, FULLY OR IN ANY PART, DO NOT USE OUR REFERRAL PROGRAM.

All of the definitions contained herein shall be interpreted according to the meanings ascribed through this Agreement and WhiteMarket Terms of Use.

Participating in Our Referral Program (“Referral Program”), and sharing the User’s unique referral link (“Referral Link”), User of Our Website provides Us with full and explicit consent to accept and comply with the Referral Program as stated below.

Upon participation in the Referral Program the User represents and warrants (i) he/she is over 18 years of age, and (ii) has full legal capacity to enter the Program, and (iii) participation in the Program is legal according to the laws of his/her country. It`s User’s responsibility to follow the rules, laws and regulations of his/her countries of residence, location and citizenship, as well as the rules of third-party services, which are exploited in the course of User’s activities in the Referral Program.

1. Participation

   Subject to User’s compliance with the terms of Referral Program, WhiteMarket enables User to participate in the Referral Program and to receive the corresponding fee (hereinafter “Referral Fee”) till 31.12.2023.

   The participation in the Referral Program is allowed only to the registered users of the WhiteMarket. WhiteMarket.

   The User may invite others to register on WhiteMarket, providing them with the Referral Link. Third parties invited by the User via the Referral Link and registered on WhiteMarket are deemed to be leads referred by the User (“Referrals”). If Referral has visited the Website via more than one Referral Link prior to registration, the most recently used Referral Link will prevail.

   WhiteMarket has the right at its sole discretion to reject Referrals application for User registration on WhiteMarket.

   The User shall not obtain any rights, licenses, permits in or to the intellectual property rights of WhiteMarket. Neither the User is allowed to use the WhiteMarket name or logo without the prior written approval of WhiteMarket.

   The User is not allowed, without the prior written consent of the WhiteMarket, to publish or distribute any printed, digital or other material in connection with the Referral Program, with the the Referral Link.

   The User is not an employee, agent, representative or advisor of WhiteMarket, nor has any authority to act on behalf of WhiteMarket.

2. Referral Fee

   According to the WhiteMarket Terms of Use, WhiteMarket takes commission for successful Item transactions between Users (“Commission”). The User is entitled to twenty percent of Commission deducted by White Market for each successful Item transaction, being executed with the of the Referral on WhiteMarket. The User is entitled to Referral Fee only if the Item transaction sum is equivalent or higher than 1 (one) USD.

   The User hereby understands and agrees that Referral Program is valid till 31.12.2023 and further Item transactions whereby the Referral is a party, are not subject to Referral Fees.

   The Referral Fee is paid to the User by WhiteMarket to the User’s account with WhiteMarket as a Deposit. The Referral Fee is paid in automatic mode upon the successful Item transaction completion Users. The Referral Fee is subject to all of the limitations foreseen to Deposit under the WhiteMarket Terms of Use.

   Any and all costs and expenses for attracting Referrals shall be borne solely by the User. No expenses incurred (if any) by the User in respect to his/her performance in the course of Referral Program shall be reimbursed by WhiteMarket.

   The User is solely responsible for determining any income (or any other) tax liabilities, which the User may or may not have, and for fulfillment of obligations to pay such taxes. If you are concerned your tax obligations, please consult a qualified tax advisor.

3. Rules Abuse Prevention

   If WhiteMarket suspects that User has not used the Referral Program in a good faith and/or has breached the terms and conditions of this Referral Program, WhiteMarket has the right to refuse to pay Referral Fee to such User.

   The User represents and warrants that he/she will not use WhiteMarket in any way to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed unfair, disruptive, harassing, harmful, illegal, hateful, obscene; as well in any way which may result a rivalry with WhiteMarket.

   WhiteMarket will determine, in its sole and absolute discretion, whether there has been a breach of the terms of the Referral Program. In the event of such breach, WhiteMarket may take action as at its discretion defined as sufficient for cure and/or remunerate such a breach, including (but not limited to) closing the User`s account, closing the Referral`s account, freezing Funds, suspending and/or terminating the Referral Program.

4. Amendments

   WhiteMarket reserves the right to at any time update, amend or modify any part of this Referral Program or to otherwise change the Referral Program or its part, without prior notifications. Any the Referral Program shall be binding upon publication hereby. The User agrees that such amendments may affect the Referral Fees amounts.

   Its User’s obligation to be acquainted with the actual version of the Referral Program published prior to any activity connected with Referral Program.

   For your convenience, the date of the publication is stated on the top of this page.

5. Limitation of Liability

   To the maximal extent permitted under the applicable Law, the Referral Program is provided on an “as is” and “as available” basis and WhiteMarket expressly disclaims, and the User waives, any and all warranties of any kind, whether expressed or implied, including, without limitation, implied warranties of functionality, fitness for a particular purpose or non-infringement or warranties arising from course of performance, course of dealing with or use of the Referral Program.

   WhiteMarket does not assume any liability with regard to User’s, Referrals’ or any third parties’ use or failure to use Referral Link.

   Without limiting the foregoing, WhiteMarket does not represent or warrant that the Referral Program is accurate, complete, up-to-date and error-free.

   Without limiting the foregoing, the User hereby understands and agrees that WhiteMarket will not be liable for any losses of income or damages, arising out of or relating to the Referral Program.

   WhiteMarket is not responsible for acts or defaults or the negligence of the third parties or their directors, employees, contractors, agents or representatives.

   The User indemnifies WhiteMarket against all liability, actions, charges, costs, claims and demands incurred by WhiteMarket in respect of User’s use of Referral Program.

6. Dispute resolution

   Any dispute between the User and WhiteMarket, should be resolved initially through negotiations within 10 (ten) business days. If a dispute was not resolved by negotiations, it should be referred to and finally resolved by the competent court under the law of the British Virgin Islands.
